Pilot Program of Migration Regularization

Discover the Pilot Program of Migration Regularization

This pilot program was implemented in March 2021 and applies to migrants whose immigration document expired before January 1st, 2020 and who, for whatever the reason, were unable to renew it. The aim is to regularize the migration status of foreigners in Mexico who meet the conditions established to obtain a temporary residence without a work permit. It is important to note that this pilot program is NOT a Temporary Migration Regularization Program, like those applied during the years 2015, 2016 and 2017.

Observed Requirements:

  1. That the foreign national proves that he or she has a document that lost its validity before January 1st , 2020, such as a visitor card, temporary resident card, temporary resident student card or a multiple migration form.
  2. Passport or identity and travel document. In the case of Venezuelans, it has been observed that it is not necessary for the passport to be valid at the time of submitting this application, but it may vary from one entity to another.
  3. Write freely about the case explaining why you are in an irregular situation, and make known your intention to benefit from this pilot program. Also fill out the respective regularization request form because of having an expired document or carrying out unauthorized activities: https://www.inm.gob.mx/tramites/publico/estancia.html
  4. To prove payment of duties: Being in an irregular situation, you need to make three payments: https://www.gob.mx/inm/articulos/conoce-las-nuevas-tarifas-de-pagos-de-derechos-2021?idiom=es
  5. The first payment will be intended for the receipt and study of the application and, where appropriate, the regularization of the migratory status: $1,410 MXN.
  6. The second payment will be for the number of years of validity you want for your residence, it can be for one year or up to four years. The price may vary depending on the number of years (one year: $4,413 MXN, two years: $6,613 MXN, three years: $8,376 MXN, four years: $9,927 MX).
  7. The last payment will be a fine set by the National Institute of Migration as a sanction for being in an irregular situation. This is defined based on your migration history and economic capacity, but ranges of this fine can go from $1,800 MXN to $9,000 MXN.

Recommendations:

Consider that the program does not have an expiration date, therefore, you can benefit from it as long as it is not expressly canceled

  • Even if you can apply for residence for one year, it is recommended that you apply for it for four years so that you later have the right to apply for permanent residence.
  • Although the residence does not have a work permit, you then have the option to apply for a work permit, fulfilling the applicable conditions. Learn more:  What you need to get a job in Mexico 👉
  • In the case of family members, they can benefit from this program if they are in the same situation or opt for regularization by family unit later.
