a) What does it mean to be a person who has suffered persecution?

This is someone who has fled where they live because of fear that someone will hurt them. This situation can include someone who has been threatened, for example, through threatening notes, calls, messages etc. These threats are made with the intention of hurting that person and they can come from different persecutors, such as, gangs, the government, criminal organizations, etc. In addition, this situation can have occurred over a period of days, weeks or months.

b) Who can request asylum?

Any person who has been the victim of persecution or who is afraid to return to their country because their life and integrity are in danger, or such is the situation for a third party -in the case that the person requesting asylum cannot do so directly, because they are in detention or due to an external severe circumstance.

c) Who can receive asylum in Mexico?

  • Any person who has credible fear that their life and integrity are in danger, due to their gender, race, religion, nationality, belonging to a particular social group or because of their political opinions, or due to general violence, aggression by a foreign country, internal conflicts, the violation of human rights on a massive scale or other circumstances that greatly disturb public order in the person’s country of origin.
  • Any person who, even though they may have moved from their place of origin (neighborhood, town, city or state) their life or personal integrity are still in danger, or the life or personal integrity of a family member, friend or acquaintance is in danger.
  • Any person who has not received protection from their government. 

d) When can I request asylum?

  • You have 30 business days, from the date that you enter Mexican territory to request asylum. In other words, weekends (Saturdays and Sundays) do not count.

If you surpass the 30-day limit:

  • The COMAR will give you an interview  3 days after you notify them you have passed the require time.
  • They will give you a time limit of five days to turn in a justification that explains why you did not go to the COMAR office previously.
  • In those five days, you must present proof of the reason(s) why you were unable to go to the COMAR office.
  • A few days later, you will be notified if your petition was accepted or rejected because of having submitted it after the time limit.
  • COMAR accepts requests that are outside the time limit on an exceptional basis, when you can show that it was not possible for you to submit your request on time, for example, based on the following reasons:

When you are traveling with small children, when you or the people accompanying you have gotten sick, if you do not speak Spanish, pregnant women, or when you have been the victim of a crime in Mexico.

e) What do I do if the time limit has passed?

In the case of presenting a late request, you can present the following proof to COMAR:

1 A declaration in which you describe what has happened in your life since you entered Mexican territory up until the day you went to the COMAR office

2Copies of medical prescriptions

3Copies of police reports made in Mexico

4Any proof that shows that it was impossible for you to have requested asylum previously

f) To what authority do I present my asylum claim?

To the office of COMAR (Mexican Commission for Assistance to Refugees) or if you are located in a place where there are no COMAR offices you can go to the National Institute of Migration (INM).

h) What kind of proof must I show?

You can present ALL SORTS of proof: Cut-out sections of newspapers, cell phone photos or from Facebook or internet news articles. You can even request that all of your family members that accompany you be interviewed as well.
