Ask for asylum

Recommendations for those wishing to request asylum 👉

  • If you do not have official documents with you, it is not necessary to show these documents, because international law gives you “the benefit of the doubt,” therefore, the lack of these official documents should not be an impediment for you to request asylum.  
  • If you did not request asylum within the first 30 days after your entry into Mexico, you can still request asylum, while explaining the reasons why you could not make the request in the allotted time.
  • If you are traveling with family, the moment that you request status as a refugee, you can also request that all of your family members also be recognized as refugees in the same process. But, if you believe that your family members have had a different experience with the persecution they have suffered, you must request that each person request their own process and each case will be looked at individually.
  • Take into consideration that the law establishes a 45-day period in order for your petition to be resolved, but this process may take a little longer; recently, we have seen cases that take more than 6 months to be resolved.
  • Remember that you may not leave the country while your petition is in process, nor can you leave the city where you began your process, and you must attend an appointment to sign paperwork on a weekly basis until your process is complete.
  • You have the right to receive a CURP (Unique Population Registry Code) at the moment you receive proof that you have submitted your case. If you don’t have it, you may request it of COMAR.
  • You have the right to receive a visitor’s card, based on humanitarian reasons (Tarjeta de Visitante por Razones Humanitarias). It is free. 
  • This allows you to obtain legal status in Mexico
  • This card is usually valid for one year
  • It carries with it an implicit right to work in Mexico
  • It allows you to travel freely throughout the country (however, as required by COMAR you are obligated to not leave the state in which you requested recognition as a refugee)
  • You cannot renew this card unless you reach the expiration date and you continue in the status of requesting recognition as a refugee
